LPF Rules Committee held is regular meeting on Wednesday, June 22.
Attendance: Greg Peele (Chair), Omar Recuero (Vice-Chair), Matt Horvath (Secretary)

We passed one motion with unanimous vote.

2022-R-004: Motion to Adopt Response to Lee County
Mover: Greg Peele
Disposition: Passed 3-0

I move for the LPF Rules Committee to adopt the findings and response to the complaint filed by Michael Higgins against the Libertarian Party of Lee County as presented.

Summary version:
  • All LPF members residing in Lee shall be constitutionally entitled to vote on all EC regular and special elections and motions to amend constitution and bylaws at any meeting
  • LPLC unknowingly violated LPF Constitution by denying Mr. Higgins ability to vote on ABM elections as documented by LPLC ABM minutes
  • LP Lee requirements for running for LP Lee office are constitutionally valid and enforceable, but the intent to run requirement explicitly states “annual meeting” and thus does not apply to special elections or July Secretary election
  • LP Lee needs to publish public notice of all meetings (including EC meetings) on its website; the current quarterly notice for general meetings is legally valid and binding
  • LP Lee minutes do not reflect the alleged suspension of RONR that Higgins claims; if this happened it was grossly out of order and not documented in the minutes, but would need independent testimony confirming it happened

In short, we found this to be a relatively minor matter that should be resolved within Lee County and should not require further action from the LPF Executive Committee.

These findings were emailed to the LPF EC, LP Lee EC, and the original plaintiff Michael Higgins on June 26, 2022. Since then, LP Lee has conducted their July meeting and elected a new Secretary with no new issues being returned to the Rules Committee at this point. We will therefore consider this matter closed unless directed otherwise.

Other Actions
  • Reviewed recommitted motions 2022-ABM-C01 and 2022-ABM-C02 to propose for adoption with amendment next meeting.
  • Reviewed standing rules to recommend rescinding Article V Sections 4, 5, and 7 at our next meeting.
  • Informally advised various county chairs on LPF constitution and Florida statutory as requested

Planned Activities
  • Complete sample county affiliate constitution and bylaws to return to Affiliate Support
  • Continue reviewing recommitted 2022 Rules motions
  • Continue review of Standing Rules to identify sections to strike as redundant or unnecessary
  • Respond to outstanding LP Broward inquiry
  • Respond to any new inquiries from EC, affiliates, and other committees

Schedule
  • Meetings will occur on fourth Wednesday at 6:30pm on Discord
  • Committee will operate continuously on Discord in between meetings
